Terms of Service

By accessing or using CrafyArt Invites ("the Service"), operated by CraftyArt ("we", "us", "our"), you agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms in their entirety, you must not use the Service.

These terms apply to all users of the Service, including individuals who create campaigns, upload contact lists, and send WhatsApp messages through the platform.

CrafyArt Invites is a bulk WhatsApp invitation platform that enables users to:

• Upload PDF or image invitation designs.
• Import guest contact lists via CSV/TSV files or manual entry.
• Personalise messages with variable data (guest names, venue, dates, etc.).
• Send personalised WhatsApp messages to their guest list via two methods: Personal WhatsApp (QR login) or CrafyArt Invites Official WhatsApp (Meta Business API).
• Track delivery status of sent messages in real time.
• Schedule campaigns for future sending.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

CrafyArt Invites offers two distinct methods for sending WhatsApp messages. The terms, risks, and responsibilities differ significantly between them:

• Loss of your WhatsApp account, mobile number, or any associated data due to WhatsApp/Meta enforcement action.
• Failure of message delivery due to WhatsApp rate limiting, account suspension, or API changes.
• Loss of business, revenue, reputation, or goodwill arising from the use or inability to use the Service.
• Any claim arising from your violation of WhatsApp's, Meta's, or any other third party's Terms of Service.
• Data loss due to third-party infrastructure failures beyond our reasonable control.
• Damages arising from your guest's receipt of or reaction to messages sent through the platform.

Our total cumulative liability to you for any claim arising from the Service shall not exceed the total amount you have paid to us in the 30 days preceding the claim.

• Each successfully attempted message delivery consumes one (1) credit from your account, regardless of whether the recipient actually receives or reads the message.
• Test sends also consume credits.
• Credits are non-transferable, non-refundable, and do not expire.
• Credits consumed for messages that fail due to WhatsApp blocking your number (Personal method) are non-refundable.
• Credits consumed for messages that fail due to invalid mobile numbers provided by you are non-refundable.
• If our platform experiences a technical fault on our side that results in credit deduction without sending, we will restore those credits at our discretion upon verified report.
• All prices are inclusive of applicable taxes unless otherwise stated. We reserve the right to change credit pricing with 14 days' notice.

You agree not to use CrafyArt Invites for any of the following:

• Sending spam, unsolicited commercial messages, or messages to contacts who have not consented to receive them.
• Sending messages that are abusive, threatening, defamatory, obscene, fraudulent, or in violation of any law.
• Attempting to reverse-engineer, exploit, or circumvent any security measures of the platform.
• Sharing your account credentials with others or creating accounts for third parties without authorisation.
• Using the platform to send messages on behalf of a third party without their express written authorisation.
• Uploading contact lists obtained through scraping, data theft, or other unauthorised means.
• Any use that violates applicable Indian or international law.

Violation of these prohibitions may result in immediate account termination without refund.

You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease and your data will be deleted within 30 days, subject to legal retention obligations.

We reserve the right to suspend or terminate your account immediately, without notice or refund, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or caused harm to other users or the Service.

Unused credits at the time of account termination are non-refundable unless termination is caused solely by our failure to provide the Service.

We may revise these Terms at any time. If a change materially affects your rights or obligations, we will notify you by email or a prominent notice on the platform at least 14 days before the change takes effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service before the effective date.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Surat, Gujarat, India.

Before initiating any legal action, you agree to attempt to resolve disputes informally by contacting us at support@craftyartapp.com. We will make a good-faith effort to resolve disputes within 30 days.
